Tekskins Remix Competition Conditions

HOW TO ENTER

All valid Microsoft Certified, Gold Certified or Registered Members of the Microsoft Partner Program who attend the REMIX08 Australia conference at either Sydney on 20 May or Melbourne on 22 May, are eligible to enter the promotion by following the steps below:

1. Partners attending the conference may upload their design to the TekSkin Website: http://www.tekskin.com.au/catalog/competitions.php
   

2. A confirmation email will be sent to all entrants, confirming their entry has been received.
   

3. At the close of the promotion, all entries will be reviewed and judged by Microsoft, with the 100 most compelling and creative entries receiving a complimentary TekSkin.
   

CONDITIONS OF ENTRY

1. Instructions on how to enter form part of the conditions of entry. By participating entrants agree to be bound by these conditions.
   

2. Entry is open to all valid Microsoft Certified, Gold Certified or Registered Members of the Microsoft Partner Program in Australia. Employees and their immediate families of the promoter, its retailers, suppliers and associated companies are not eligible to enter. One entry per person only.
   

3. The Promoter in its absolute discretion reserves the right to verify the validity of all entries and to disqualify any entrant who the Promoter believes has either tampered with the entry process, or who has submitted an entry which is not in accordance with these conditions of entry.
   

4. The promotion commences at 09:00am (AEST) on 20th May 2008 and closes at 12:00pm (AEST) on 20th June 2008 (“Promotional Period”).
   

5. To receive an eligible entry into the promotion, eligible entrants will be required to follow the link provided to the online registration form on the TekSkin website http://www.tekskin.com.au/catalog/competitions.php where they will be able to complete the entry form and upload their original design to the TekSkin Website in accordance with the requirements on the TekSkin Website (at the address provided above) during the Promotional Period. The Promoter is not responsible for the content or administration of the TekSkin website including any applicable terms of use. A confirmation email will be sent to all entrants, confirming their entry has been received.
   

6. Each eligible entrant warrants that the design he/she submits is an original design not copied wholly or in part from any other materials or other sources anywhere in the world and that submission of the design will not violate the rights (including copyright) of any third person. The entrant releases and indemnifies the Promoter for any claims made against it in relation to infringement of copyright, moral rights, or any other intellectual property rights as a result of the entrant submitting the design in this promotion or the Promoter’s use of the design.
   

7. All valid entries received by the closing date will be reviewed by the judging panel. This is a game of skill and chance plants no part in determining the winners.
   

8. The 100 most compelling and creative entries as judged by the promoter will win a TekSkin valued at RRP $29.00 (incl GST). Winners can choose to design their own the Tekskin or choose an existing design. Total number prizes = 100. Total prize value = $2,900 (incl GST).
   

9. Microsoft will confirm via email whether or not your entry has been successful (one of the chosen 100) by COB Friday 4 July 2008. The TekSkin prize will be posted in the mail to the 100 successful entrants.
   

10. Prizes are not exchangeable, transferable or redeemable for cash. If the promoter is unable to supply the nominated prize, the promoter reserves the right o supply another prize of greater or equal value.
    

11. The promoter’s decision is final and no correspondence will be entered into. No responsibility is accepted for entries not received by the promoter. Entries will be deemed void if stolen, forged, mutilated or tampered with in any way.
    

12. All entries are deemed to be received at the time of receipt into the promotion database and not at the time of transmission by the entrant. Incomplete or incomprehensible entries will be deemed invalid. Any form of automated entry using other devices or software is invalid.
    

13. The stated prize value is the recommended retail value (including GST) in Australia as provided by the supplier and is correct at the time of printing. The Promoter accepts no responsibility for any variation in the value of the prize. The promoter and its associated agencies and companies accept no responsibility for prizes damaged or lost in transit.
    

14. In the event that a prize is not claimed the judges will select an alternate winner to receive the prize.
    

15. The prize winners must, at the promoter’s request, participate in all promotional activity (such as publicity and photographs) surrounding the winning of the prize, free of charge, and they consent to the promoter using their name and image in promotional material.
    

16. Subject to any applicable law which cannot be excluded, the Promoter and its related bodies corporate shall not be liable for any loss, damage or injury suffered or sustained (including but not limited to direct or consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with the promotion or any prize.
    

17. Any costs associated with entering the competition and accessing the website are the responsibility of the entrant.
    

18. The Promoter assumes no responsibility for, and the entrant releases the Promoter from responsibility for, any failure to receive an entry or for inaccurate information or for any loss, claim, damage, or injury to person or property (including computer systems and servers) as a result of the entrants participation in this promotion or the conduct of the promotion generally or as a direct or indirect result of an entrants error, any technical problem of any kind including communications or network failure, unauthorized access to, transferring or theft of data, whether caused by the entrant associated with the equipment or programming used in the conduct of this promotion. If, because of any such problem, this promotion is not able to be conducted as planned and/or the promotions administration, security, fairness or integrity are compromised or affected, the Promoter may cancel, terminate, modify or suspend the promotion and/or disqualify any entrant involved in interfering or tampering with the conduct of this promotion.
    

19. Details from all entries will be collected and used for the purposes of conducting this promotion (which will include disclosure to third parties for the purpose of processing and conducting the promotion) and for publicity surrounding the promotion. By entering the promotion entrants consent to the use of their information as described. Entrants may access and/or change their data by following the procedures outlined in the Promoters privacy policy which is available at www.microsoft.com/australia/privacy. The Promoter will only use your personal details for marketing purposes outside those described above if you “opt in” to join the mailing list when prompted.
